By creating an account, accessing, or using Taciturn Studios LLC, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Taciturn Studios LLC is an AI-powered content generation platform that enables users to create books, stories, covers, puzzles, and other written or visual content ("Generated Content") for personal and commercial use, including publication on platforms such as Amazon Kindle Direct Publishing (KDP). The Service operates on a credit-based subscription model, where credits are consumed each time content is generated.

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period, with or without prior notice.

Taciturn Studios LLC offers subscription plans that provide a monthly allocation of credits. Credits are used to generate content and reset at the beginning of each billing cycle. Unused credits do not carry over to the following month unless otherwise specified in your plan.

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly set forth in our Refund Policy. We reserve the right to modify pricing at any time, with at least 30 days' notice to existing subscribers. Continued use of the Service after a price change constitutes acceptance of the new pricing.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of the paid period.

Your Content: You retain full ownership of all Generated Content created using the Service. By using Taciturn Studios LLC, you are granted a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and publish the Generated Content for any lawful purpose, including commercial publication.

Our Platform: Taciturn Studios LLC retains all rights, title, and interest in and to the Service itself, including its software, algorithms, user interface, trademarks, and all underlying technology. Nothing in these Terms transfers any ownership of our intellectual property to you.

AI-Generated Content Disclosure: Content generated by the Service is produced using artificial intelligence. You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions. It is your responsibility to review applicable laws in your jurisdiction before publishing or commercializing Generated Content. We make no representations regarding the copyrightability of any Generated Content.

Third-Party Rights: You are solely responsible for ensuring that your use of Generated Content does not infringe upon the intellectual property rights of any third party. Taciturn Studios LLC is not liable for any claims arising from your use, publication, or commercialization of Generated Content.

You agree not to use the Service to generate content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringes upon the intellectual property rights of any third party
• Contains sexually explicit material involving minors
• Promotes violence, discrimination, or hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Constitutes spam, phishing, or other deceptive practices
• Violates any applicable local, national, or international law or regulation
• Is intended to mislead readers about the authorship or origin of the content without appropriate disclosure

We reserve the right to remove any Generated Content and suspend or terminate accounts that violate this policy, without prior notice and without liability to you.

The Service uses large language models and image generation models to produce content. While we strive for quality and accuracy, we make no warranties regarding the accuracy, completeness, originality, or fitness for a particular purpose of any Generated Content. AI models can produce errors, inconsistencies, or content that requires editing before publication.

You are solely responsible for reviewing, editing, and verifying all Generated Content before use, publication, or distribution. Taciturn Studios LLC is not responsible for any errors, omissions, or inaccuracies in Generated Content, or for any consequences arising from your reliance on such content.

The Service may integrate with or link to third-party platforms, including Amazon KDP, payment processors (Stripe), and email service providers. Your use of such third-party services is governed by their respective terms of service and privacy policies. Taciturn Studios LLC is not responsible for the practices, content, or availability of any third-party services.

To the maximum extent permitted by applicable law, Taciturn Studios LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.

In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) one hundred US dollars ($100).

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

You agree to defend, indemnify, and hold harmless Taciturn Studios LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to any use of Generated Content.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by sending an email notification to registered users. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
